Global Terms of Use

By accessing, creating an account, downloading, installing, interacting with, or utilizing any of our websites, games, ecosystems, applications, and associated platforms (collectively referred to as the "Astorny Services"), you expressly declare, acknowledge, and agree that you have read, comprehensively understood, and consented to be bound by all clauses, conditions, and strict guidelines set forth in these Global Terms of Use.

If you do not agree with any provision herein, partially or entirely, you must immediately cease the use of all our services, uninstall any associated software, and request the permanent deletion of your account. Ignorance of these terms does not excuse any violation or exempt the User from any punitive actions.

1. The Astorny Ecosystem & Intellectual Property

1.1. Absolute Ownership and Copyrights

Absolutely all content, assets, and technology present within the Astorny ecosystem are the exclusive, proprietary, and inalienable property of Astorny Games Studio LTDA. This includes, without limitation: game engines, source codes, software architecture, databases, user interfaces (UI/UX), algorithms, logos, registered trademarks, product names, concept arts, 3D models, textures, soundtracks, narrative texts, game mechanics, and overarching visual designs.

This property is strictly protected by national and international copyright laws, trademark laws, and intellectual property treaties. No title, ownership, or intellectual property rights are transferred to the User under any circumstances.

1.2. Strict Prohibition of Commercial Use and Unofficial Media

The User is granted a limited, revocable, non-exclusive, and non-transferable license to access the Astorny Services solely for personal, non-commercial entertainment. It is strictly prohibited to:

• Utilize, copy, reproduce, modify, decompile, reverse-engineer, or distribute images, videos, audio, code, or any visual asset from Astorny's games and platforms for commercial purposes without prior, express, and documented authorization from Astorny's Legal Department.
• Create, disseminate, or promote unofficial images, manipulated arts, or materials that falsely simulate being official Astorny products in order to obtain profit, deceive the public, or maliciously divert digital traffic.
• Register domains, create websites, establish social media profiles, or register corporate entities that use the name "Astorny" or any phonetic/visual variations aiming to confuse, mislead, or exploit the user base.

1.3. Zero Tolerance for Fake Ads and Unauthorized Promotion

Astorny adopts an absolute zero-tolerance policy against the misappropriation of its assets for the creation of false advertisements (Fake Ads). It is expressly forbidden for any individual or corporate entity to capture screens, videos, characters, or the Astorny logo to promote third-party games, betting applications, malicious websites, or any other unaffiliated service.

Astorny will systematically execute immediate legal actions, including but not limited to DMCA takedown notices, digital injunctions, and civil lawsuits for intellectual property infringement and financial damages, against any entity that exploits our intellectual property in external ad networks.

2. My Astorny Account

The "My Astorny Account" functions as the User's central digital identity passport. It is strictly required to authenticate and access the expansive products, universes, and services developed by Astorny Games Studio LTDA.

2.1. Account Creation, Accuracy, and Sole Responsibility

Upon registration, the User solemnly agrees to provide accurate, currently valid, and complete personal information (including full legal name, active email, and verifiable date of birth). Astorny reserves the unilateral right to suspend or permanently eradicate accounts created with intentionally false data, impersonated identities, or generated via automated systems (bots/scripts).

Account security remains the sole, unshared responsibility of the User. Astorny provides and strongly encourages the use of Two-Factor Authentication (2FA) across the ecosystem. We bear zero legal, technical, or financial responsibility for account compromises, identity theft, loss of digital assets, or data breaches resulting from the User's negligence in sharing passwords, lending devices, using unauthorized third-party clients, or mismanaging 2FA backup codes.

2.2. Prohibition of Account Sharing and Transfer

Your My Astorny Account is personal and non-transferable. You are strictly prohibited from sharing your login credentials with friends, family members, or third parties. Selling, buying, gifting, renting, or inheriting accounts is a direct violation of these terms and will result in the immediate, permanent ban of the account in question, alongside the hardware ban of the individuals involved.

2.3. Child Protection and Family Center Protocols

Astorny is deeply committed to protecting the psychological integrity and digital privacy of minors. Accounts registered with birth dates indicating the User is under the legal digital age (in accordance with global COPPA and GDPR-K child protection laws) will automatically be subjected to mandatory algorithmic restrictions.

These systemic safety locks restrict sensitive data sharing, external link posting, and unsolicited communications. These restrictions can only be managed, modified, or bypassed by a verified legal guardian through the official Astorny Family Center application. Any attempt by a minor to bypass these age-gates by falsifying their date of birth will lead to immediate account termination.

2.4. Tag-Name System and Profile Alterations

User visual identification is seamlessly handled by a custom Name followed by a system-generated Tag (e.g., Name#1234). Modifying the "Tag-Name" requires the consumption of Gemins (the platform's virtual currency). Astorny does not guarantee the availability, reservation, or exclusivity of specific nomenclatures.

Inappropriate, offensive, sexually explicit words, or terminologies that incite hatred, violence, or illegal activities will be automatically blocked by our AI moderation systems. Any attempt to bypass the prohibited nomenclature filters using special characters or deliberate misspellings will result in severe administrative punishment, up to a permanent hardware ban.

3. Astorny Duo Program (Content Creators)

The Astorny Duo Program is an exclusive, privilege-based initiative granted at the sole discretion of Astorny for verified content creators (Duals) who produce high-quality, community-driven content regarding our universes.

3.1. Eligibility and Compliance

To join and maintain status in the Astorny Duo Program, Duals must strictly meet the ongoing requirements, including holding an active My Astorny Account with mandatory 2FA enabled, maintaining a minimum follower count on external social networks, and remaining active by posting Astorny-related content at least once every 90 days.

3.2. Conduct and Usage of the Verified Badge

Duals receive an exclusive Verified Badge and visual distinction across the ecosystem. The User unconditionally recognizes that holding the Dual status does not make them an employee, contractor, spokesperson, or legal representative of Astorny.

It is strictly prohibited to use the influence of the Verified Badge to coerce other users, promote hate speech, execute targeted harassment (cancel culture), perpetuate scams, or charge illicit fees from third parties while falsely claiming to possess "internal contacts" or administrative power within the company.

3.3. Confidentiality and NDAs

Duals may occasionally receive early access to unreleased games, confidential updates, and internal features. The User agrees to be bound by strict Non-Disclosure Agreements (NDAs). Leaking private information, sharing beta footage before the authorized embargo date, or distributing proprietary assets will result in immediate expulsion from the Duo Program, a permanent ban across all Astorny services, and civil litigation for breach of contract.

4. Virtual Economy and Gemins

4.1. Definition of Virtual Currency

Gemins are the official, closed-loop virtual currency of the Astorny ecosystem. The User acknowledges that Gemins, along with any other digital items or in-game assets, possess no real-world monetary value and cannot be redeemed, cashed out, or exchanged for fiat currency (e.g., USD, BRL, EUR) under any circumstances.

Astorny retains the absolute, unquestionable right to manage, regulate, control, modify, inflate, or eliminate Gemins and their purchasing power at its sole discretion, without any liability or obligation to compensate the User.

4.2. Absolute Prohibition of the Black Market (Zero Tolerance)

To guarantee fairness, macroeconomic stability, and security, Astorny absolutely and irrevocably prohibits any type of "parallel market", Real Money Trading (RMT), black market, or unauthorized external trading of virtual goods.

The User may not, under any circumstances, sell, buy, exchange, rent, auction, or transfer the following elements for real-world money, cryptocurrencies, PIX, or outside barter arrangements:

• Balances, unauthorized recharges, or transfers of Gemins outside official Astorny payment gateways.
• In-game items, exclusive cosmetics, titles, or progression achievements.
• Virtual gifts, badges, or the status of a Verified Account.
• "Boosting" or "Elojob" services (charging money to play on someone else's account to achieve a higher rank or complete missions).

Detection of RMT or black-market involvement will trigger the immediate, irreversible ban of all connected accounts (buyers, sellers, and middlemen), total confiscation of all virtual assets, and a permanent hardware (HWID) and IP block.

4.3. Payment Fraud and Chargebacks

Any attempt to defraud Astorny's payment systems, utilize stolen credit cards, or initiate malicious chargebacks (requesting a refund from the bank after receiving the Gemins or digital goods) will result in the immediate suspension of the My Astorny Account and a permanent ban. Legitimate refund requests must be processed strictly through Astorny's official Support channels.

5. User Conduct and Social Interactions

Astorny provides robust communication channels, including global chats, direct messaging, and forums, to foster a united, collaborative community. Access to these tools is a conditional privilege, not a right.

5.1. Prohibited Communications

When utilizing our services, the following actions are strictly prohibited and will result in immediate punitive action:

• Harassment and Grooming: Any form of moral or sexual harassment, cyberbullying, violent threats, or the grooming/solicitation of minors. Such acts will be immediately reported to international law enforcement agencies.
• Doxing: Publishing, sharing, or threatening to share private, real-world information of other users or Astorny staff (e.g., residential addresses, phone numbers, full names, financial data).
• Malicious Links and Spam: Distributing URLs that direct users to phishing sites, malware downloads, pornography, IP grabbers, or unauthorized third-party advertisements.
• Toxicity and Hate Speech: Promoting discrimination, slurs, or derogatory language based on race, gender, sexual orientation, religion, disability, or nationality.

5.2. Monitoring and Data Retention

To ensure community safety and enforce these Terms, Astorny reserves the explicit right to automatically monitor, analyze, filter, and log chat histories, interactions, and communications utilizing advanced AI heuristics and human moderation. The User acknowledges and agrees that they possess no expectation of absolute privacy in public or unencrypted communications within the Astorny Ecosystem. These logs may be utilized as irrefutable evidence for bans or forwarded to legal authorities if criminal activity is detected.

6. Fair Play, Hacks, and Modifications

Astorny games and platforms must be experienced in their original, unmodified state to ensure a fair, competitive, and secure environment for all global players.

6.1. Third-Party Software and Cheats

The User is strictly forbidden from creating, downloading, utilizing, distributing, or promoting any form of cheats, hacks, aimbots, ESPs, macros, automated clickers, or unauthorized third-party software designed to modify the core gaming experience or grant a mathematically unfair advantage.

6.2. Client Modification and Reverse Engineering

It is strictly prohibited to decompile, reverse-engineer, or maliciously modify the game client or network packets. Unofficial modifications (Mods) that attempt to bypass monetization systems, illegally unlock paid items, or corrupt central server data are classified as severe cyber-offenses.

6.3. Exploitation of Bugs (Glitches)

The continuous and deliberate exploitation of developmental bugs, glitches, or design flaws for personal competitive benefit, financial gain (e.g., infinite Gemins glitch), or to the targeted detriment of the community is strictly forbidden. Users who discover severe exploits are obligated to report them privately to Astorny Support.

7. Limitation of Liability and Disclaimers

7.1. "As Is" Service Provision

The Astorny Services are provided on a strictly "AS IS" and "AS AVAILABLE" basis. Astorny makes no warranties, express or implied, regarding the continuous availability, error-free operation, or absolute impenetrable security of its servers. We do not guarantee that the services will function without interruptions, crashes, or data loss.

7.2. Exemption from User Negligence

Astorny continuously invests in world-class cybersecurity infrastructure. However, we are not legally, technically, or financially liable for unauthorized access resulting from the User's negligence or conscious acts. This encompasses:

• Loss of accounts or assets due to Social Engineering, scams, or Phishing campaigns where the User voluntarily inputted their credentials into fake websites.
• Intrusions resulting from malware, keyloggers, or viruses present on the User's unpatched physical devices.
• Damages arising from conscious actions, such as voluntary trades, trusting deceptive players, or engaging in illegal black-market negotiations.

Astorny will not execute rollbacks, refunds, or restoration of lost items if the compromise originated from the User's failure to secure their own environment.

8. Punitive Actions and Enforcement

Astorny Games Studio LTDA holds absolute, discretionary authority to investigate violations of these Global Terms of Use. We reserve the right to impose administrative sanctions ranging from written warnings, content removal, and balance resets, to temporary suspensions, permanent account terminations, and permanent hardware (HWID) bans.

Astorny may execute these actions at any time, without prior notice, and possesses no legal obligation to provide internal evidence, proprietary server logs, or fraud detection reports to penalized users. All decisions made by the Astorny Security Team are final and non-negotiable.

9. Governing Law and Final Provisions

Astorny reserves the undeniable right to alter, modify, or completely update these Global Terms of Use at any time, to effectively reflect legal adaptations, ecosystem expansions, or technological evolution in our platforms. Continued use of our services after the alterations are officially deemed effective constitutes your full, unconditional acceptance of the new terms.

These terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any dispute, controversy, or litigation arising from the use of our services will be submitted to the exclusive jurisdiction of the courts located in the main headquarters of Astorny Games Studio LTDA (Caçapava do Sul, Rio Grande do Sul), expressly waiving any other jurisdiction or venue, however privileged it may be.
